AL: Jefferson County debt holders file questions in challenge to largest U.S. government bankruptcy

BIRMINGHAM, Alabama -- A bank representing Jefferson County debt holders and lawyers who successfully challenged the county's 2009 occupational tax have filed their proposed questions to ask the Alabama Supreme Court about the county's right to seek bankruptcy protection.

The submissions were requested by U.S. Bankruptcy Judge Thomas Bennett, as creditors seek to block Jefferson County's Chapter 9 bankruptcy filing over its $4.23 billion in debts, including $3.14 billion for a court-ordered sewer rehabilitation program.

The creditors contend Jefferson County does not have the right under Alabama law to file for bankruptcy, because it did not have any outstanding bond debt. The county has amassed its debt through bond-like debt instruments called warrants.

But the county contends it can legitimately seek Chapter 9 protection because it had issued bonds in the past and commissioners approved a resolution in July contemplating the need for future bond sales.

The lawyers want the bankruptcy judge to ask the Alabama Supreme Court if the county must have outstanding bond debt to file bankruptcy, and what effect past county bond sales or commissioners' stated future plans to sell bonds would have on the county's right to seek protection from creditors.

In a hearing earlier this month, Bennett said he had not decided if he would submit questions to the Alabama Supreme Court on its interpretation of the state government bankruptcy law. Wednesday was the deadline for lawyers to file their proposed questions to the bankruptcy judge.

The state high court currently is considering a similar issue regarding a bankruptcy petition filed by the south Alabama town of Prichard. A bankruptcy judge rejected Prichard's petition because it had outstanding warrant debt but no bond debt, and the town filed an appeal to the state Supreme Court.

Black Male Engagement Amplifies Detroiters' Good Deeds

Black Male Engagement (BME or "be me") launched in August as an initiative to offer support and positive reinforcement to black men who are active in their communities.

The program is currently piloting in Detroit and Philadelphia, sponsored by a grant from the Knight Foundation and Open Society Foundation.

Knight's Rishi Jaitly explained BME as a "social network that's all about resident leadership." The idea, Jaitly said, was to make it easy for Detroiters to recognize one another for good work they're doing in the city.

Since BME launched, 1,065 men have shared their stories in video messages available on the organization's website. Community leaders talk about their projects and have the chance to connect with others doing similar work in Detroit.

The focus on black men, as opposed to other groups, is the product of BME organizers' experience in Detroit.

"In the course of our work here as a foundation, we've just come across a lot of engaged black men and teenagers in the community who've just played a vital role in a lot of our initiatives," Jaitly explained. "It's an easier community for us to begin with; we'd just seen so much leadership."

The list of Detroit BME participants is long and varied. It includes mentors, entrepreneurs, urban gardeners, a barber, a ball room dance instructor and City Council Member (and former interim Mayor) Ken Cockrel Jr.

Other BMErs: Eddie Connor, a 13-year cancer survivor who is now a mentor; Fran Westbrooks, founder of Detroit Comeback Kids; Curtis Lipscomb of KICK, which supports LGBT African Americans.

In his BME video, Lipscomb explains he's worked with nearly 3,500 people in nearly 20 years of service. One of those services is offering sensitivity training to Detroit Public Schools administrators with the goal of preventing bullying.

The next step for BME is to move from recognition to funding. The organization is sponsoring a grant competition, open to individuals, corporations and nonprofits. The application was just a few paragraphs long in an effort to make it easier to participate for those who had not previously looked for funding through formal grant channels.

Jaitly said BME is asking grant competitors a simple question: "What else might you do if you had access to more resources, a bigger stage?"

Those who made the second round are eligible for grants up to $50,000 to continue their community work. The winners will be announced in January, and Jaitly said he hopes some of them will go on to win future funding from local grant-making groups.

Whether or not individual BMErs win the money, Jaitly says the idea has proven a success, with members getting together informally to discuss their projects and promote strong leadership and community involvement.

"What's been fascinating is when people feel their narrative all of a sudden is being amplified by a big megaphone, that in and of itself has proved empowering," Jaitly said.

Week 17 NFL Power Rankings: NBC Sports Drops Chicago Bears To No. 25

A tough week for the Chicago Bears continues to get tougher. After losing to the Green Bay Packers on Sunday night -- despite accruing more total yards than the Packers -- the Bears have begun to slide and topple down the Week 17 NFL Power Rankings, earning a near-the-bottom No. 25 slotting from NBC Sports' Pro Football Talk:

25. Bears (No. 24; 7-8): [Kahlil Bell] may have cost Matt Forte a lot of money.

Indeed, after Bell's impressive 121 rushing yards and 38 receiving yards in Sunday's contest, the injured Matt Forte suddenly looked much less like an offensive keystone than, say, QB Jay Cutler. Forte, who is nearing the conclusion of his rookie contract with the Bears, has been lobbying the franchise for an extension, requesting rather large money, but with the apparent emergence of Bell, Forte's services may be more expendable than priceless.

In Week 16, the Bears offense put together a season-high of 441 total yards on the shoulders of third-stringers Bell and QB Josh McCown -- who threw two interceptions, but otherwise had a solid game in his first start in four years.

The Bears will be in their final action of the 2011 season this coming Sunday, taking on the Minnesota Vikings at noon CST.

Romney, Perry slap at Paul on Iran (AP)

MUSCATINE, Iowa ? Mitt Romney and Rick Perry on Wednesday assailed Republican presidential rival Ron Paul for saying the U.S. has no business bombing Iran to keep it from acquiring a nuclear weapon, drawing a sharp contrast with their rising rival as he returned to Iowa to campaign before the lead-off caucuses.

"One of the people running for president thinks it's okay for Iran to have a nuclear weapon," Romney, the former Massachusetts governor, said in this eastern Iowa city in response to a question from the audience. "I don't."

It was the first time Romney has challenged Paul directly since the Texas congressman jumped in polls. Neither Romney nor Perry, the Texas governor, named Paul, but the target was clear.

"You don't have to vote for a candidate who will allow Iran to have a nuclear weapon to wipe Israel off the face of the earth. Because America will be next," Perry said in Urbandale, reiterating a line of argument from a day earlier.

"I'm here to say: You have a choice," Perry added.

As if in rebuttal, Paul's campaign launched a new television ad describing him as "principled, incorruptible, guided by faith and principle" and the man to restore the economy. "Politicians who supported bailouts and mandates, serial hypocrites and flip floppers can't clean up the mess," it says as photos of Newt Gingrich and Romney appear on screen.

The stepped-up criticism of Paul, the libertarian-leaning Republican, comes as surveys show he's in contention to win Tuesday's caucuses.

In recent days, conservative opponents including Perry and Minnesota Rep. Michele Bachmann have increased their criticism of Paul on social issues, foreign affairs and inflammatory comments in his decades-old newsletter. By tearing him down, they hope voters will give their campaigns another, closer look after a season marked by candidates who have risen quickly in public standing only to fall back down.

Gingrich, whose slide in surveys over the past week has come as Paul has risen, said Tuesday he couldn't vote for Paul if he were to become the GOP nominee and called his views "totally outside the mainstream of every decent American" during an interview with CNN.

Gingrich, the former House speaker, began Wednesday, the second day of his Iowa bus tour with a speech to about 200 people in the atrium of the Southbridge Mall in Mason City. He plugged his support for supply-side economics favored by President Ronald Reagan.

Gingrich said the primary is giving voters a "choice between a populist supply side approach ... and a much more timid Washington-centered approach that will not create jobs."

Bachmann, who was on the 86th stop of her tour of Iowa's 99 counties, criticized both of her rivals from Texas. She accused Perry of spending "27 years as a political insider." He was a Texas legislator and agriculture commissioner before becoming governor in 2001.

Bachmann said Paul would be "dangerous as president" because of his hands-off views on national security.

Paul, for his part, was meeting with supporters near Des Moines, his first visit to the state since before the campaigns went dark for the Christmas holiday. He planned a series of events over the next two days as he looked to take advantage of a burst of momentum.

A conservative, Paul commands strong allegiance from his supporters but appears to have little potential to expand his appeal and emerge as a serious challenger for the nomination. Yet he could complicate other candidates' pathway to the nomination.

His opponents were spreading out across the state to woo potential caucus-goers, many of whom are still undecided amid a flood of television and radio ads.

In Independence, former Pennsylvania Sen. Rick Santorum mingled with 25 people at a diner and touted his plan to give a tax break to businesses that bring their operations back to the United States.

He told diners: "Things are going great, we've got momentum." He began airing a new radio ad Wednesday that promotes his hardline opposition to abortion and describes him as a "father of seven, a home-schooler and a devoted husband for 21 years."

Romney kicked off a three-day bus tour in the eastern edge of the state, in Muscatine, and shook hands with an overflow crowd at Elly's Tea and Coffee House. The line to get in stretched into the street.

Beginning the day, Romney told Fox News Channel that he was only joking Monday when he criticized Gingrich's failure to earn a spot on the Virginia ballot as something out of the sitcom "I Love Lucy."

"I hope the speaker understands that was humor, and I'm happy to tell my humorous anecdote to him face to face," Romney said.

Gingrich on Tuesday challenged Romney to make the "I Love Lucy" comparison to Gingrich's face.

Perry, looking to recapture the enthusiasm that greeted his entry into the race in August, railed against Washington and Wall Street insiders as he met with conservatives for breakfast near Des Moines.

"Why should you settle for less than an authentic conservative who will fight for your views and your values without apologies?" he asked, delivering the core rationale for his candidacy.

The packed crowd of conservatives in Urbandale applauded as he pledged to champion a constitutional amendment to balance the federal budget, secure the border within a year and crack down on illegal immigration. He also said he would bring his faith with him into the Oval Office, a nod to the Christian conservatives who have strong sway in the nominating process.

Nigeria sect clashes kill at least 68: officials (Reuters)

KANO, Nigeria (Reuters) ? Gun battles between Nigerian security forces and an Islamist sect killed at least 68 people in two days of fighting in northern Nigeria, authorities and hospital sources said on Saturday.

Militant group Boko Haram, which wants to impose Islamic sharia law across the country split roughly equally between Christians and Muslims, has been blamed for scores of shootings and bombings in Nigeria's remote, semi-arid northeast, including a spate of attacks in the past few weeks.

Nigeria's army killed more than 50 members of the sect during fighting on Thursday and Friday in the northeastern city of Damaturu, the force's chief of staff Lieutenant General Azubuike Ihejirika said in comments published in local media.

Three soldiers also died, he added.

"There was a major encounter with Boko Haram in Damaturu and we overran their stronghold and their ammunition site," Ihejirika said.

"They came with sophisticated and heavy weaponry including GPMGs (machine guns) and bombs but our trained soldiers subdued them."

Hospital sources in Damaturu said they had counted 50 bodies so far, but most of the dead were civilians.

"So far 50 bodies have been deposited at the mortuary by the military and police operatives," a hospital worker told Reuters by telephone. "They were ... seven policemen, two soldiers and 41 civilians."

In a separate incident in the city on Friday, suspected sect members opened fire on a group of policemen shortly after prayers, killing four, police said.

Residents said Damaturu was quiet on Saturday, but surveyed by a heavy military and police presence.

"Everywhere is so tense here. There's nobody on the street except security men. The bodies of those killed are being removed from the mortuary ... Our town is virtually a ghost town," Usman Mamman, a Damaturu resident, said by telephone.

CLASHES INCREASING

At least 11 people were killed in another shootout in the remote northeastern city of Maiduguri, Boko Haram's heartland on the threshold of the Sahara and bordering Chad, Niger and Cameroon, on Thursday, a morgue official said.

Clashes between security forces and the sect, whose name roughly translates as "Western education is forbidden," have become increasingly frequent in the past couple of weeks, as the north's simmering conflict escalates.

There was no immediate comment from Boko Haram, which rarely makes public statements.

Before this year, the Islamist insurgency was largely contained in its heartland in Maiduguri. It has since has spread to other parts of the north, including neighboring Yobe state, where Damaturu lies.

The town was the scene of the most deadly Boko Haram assault to date, when 65 people were killed in a wave of shootings and bombings on November 5 that left churches, police stations and mosques reduced to smoldering rubble.

This year the Islamists struck the capital Abuja twice, including a suicide car bomb attack against the U.N. headquarters that killed 26 people.

President Goodluck Jonathan, a southern Christian who has dismissed the Islamist rebellion as "a temporary setback," made no mention of the violence in a statement on Saturday afternoon to mark this year's Christmas celebrations. He focused instead on his economic "promise of national transformation."

Rob Sachs: Making Our Holiday Card List, Checking It Twice...

This year my wife and I got out ahead of the game and took our "holiday card picture" back in November. This was extremely helpful since it eliminated last year's stress of scrambling through a year's worth of photos to find a decent one. (The winning pic required some clever cropping.) With our photo ready to go, the format chosen, (thanks to tiny prints) we were ready to lick, stamp, and mail. The only thing left to do was to review "The List."

Originally our holiday card mailing list was a derivation of our wedding invite list; we figured the folks interested in watching us exchange vows would appreciate seeing the fruits of our union on annual basis. But after a few years I started throwing in work colleagues and people who were good "connections" for one reason or another. Soon the list was growing unwieldy, the tradition was getting out of hand, not too mention expensive. We had to pair down and assess, do we really need to send THIS person a card? For some advice on how to proceed I talked to my friend and Sachs holiday card recipient Sarah Maizes. Sarah also happens to write the popular blog "Mommy Lite" and is author of the book Got Milf? She told me if folks don't get a holiday card from her it's because of one of three reasons:

1) I don't have your address.
2) I don't know you well enough to send you something without looking like a stalker.
3) I just don't like you that much any more.

Sarah says her big litmus test is whether or not she really cared to get a card back. She recounted a story of a friend whom she had a falling out with and yet still sent her card (she believes accidentally, since it was sent on a printed address label). Sarah said receiving the card actually caused her stress and pain. Yuck!

So in consideration of the feelings of both our feelings and the feelings of our recipients, my wife and I came up with three additional criteria for knocking someone off our list:

1) Sending you a card feels like we're trying too hard to maintain a relationship that's let's admit it isn't really there anymore.
2) We're buddies, but you don't have kids and we know you don't have too much interest in being reminded that we do.
3) The surprised reaction you gave us last year when you received our card made us realize we were reaching a little too far.

So the cards are out and our consciences clear. As for those people in my life that fall into that space between pal and acquaintance, they may be off "The List" but they can always be my "friend" on Facebook...

Sarkozy: Paris, Berlin to push for treaty changes (AP)

PARIS ? France and Germany plan to push for fundamental changes to the European treaty governing the euro in order to save the currency, President Nicolas Sarkozy said Thursday.

Sarkozy said in a speech in the southern port city of Toulon that during their meeting in Paris on Monday he and German Chancellor Angela Merkel will unveil proposals to try to lift Europe out of its debt crisis and "guarantee" its future.

"France will push with Germany for a new European treaty refounding and rethinking the organization of Europe," Sarkozy said. "The Maastricht Treaty has revealed itself to be imperfect," Sarkozy said, referring to the pact that led to the creation of the euro currency in 1999.

"There can be no common currency without economic convergence without which the euro will be too strong for some, too weak for others, and the eurozone will break up," the French president said before an audience of several thousand sympathizers of his conservative party.

Changes in the treaty would have to be approved by all 27 EU members, 10 of whom don't use the euro currency.

Sarkozy said the process of reforming the treaty "will be long and difficult" but is necessary to protect Europe's place in the world.

Speculation is mounting that EU leaders will align their spending policies more closely to bring government debt levels under control in the future. This is seen as a necessary measure before the European Central Bank or other institutions can take more aggressive steps to help prevent the debt overload from destroying the euro and wreaking havoc in the global financial system.

Sarkozy, who is widely expected to seek a second mandate during France's April and May presidential election, brushed aside the balloting, saying he must focus on the dire financial situation.

Los Angeles wind storm disrupts flights, cuts power (Reuters)

LOS ANGELES (Reuters) ? A powerful wind storm with gale-force gusts left much of the Los Angeles area strewn with toppled trees and downed power lines on Thursday, slowing traffic, damaging homes and knocking out electricity to over 350,000 customers.

An hourlong power outage at Los Angeles International Airport forced nearly two dozen inbound commercial flights to divert to other airports, and flight delays lingered even after electricity was restored, LAX spokeswoman Nancy Castles said.

Damaging high winds also extended into other regions of the West, including Utah, where power was cut to an additional 55,000 residents, and 10 tractor-trailer trucks were tipped over by crosswind gusts north of Salt Lake City.

Los Angeles County declared a state of emergency as a result of the winds, a move that hastens the ability of state and federal authorities to provide assistance, said Tony Bell, a spokesman for county Supervisor Mike Antonovich.

Classes were canceled for thousands of public school students in the area, and utility crews worked to restore electricity and remove uprooted trees and fallen limbs that littered neighborhoods, blocking streets in many places.

Widespread power failures left traffic lights on the blink at many intersections.

Homes and parked automobiles were clobbered by fallen trees, with 42 damaged houses and apartment units declared unsafe for habitation by early afternoon in hard-hit Pasadena, but no serious injuries have been reported. A service station in Pasadena was demolished by a large uprooted tree.

The advent of high winds put fire departments throughout the region on alert for a high risk of wildfires.

Winds snapped off the top of a 100-foot-tall Christmas tree at an open-air shopping plaza in suburban Glendale, and another giant holiday tree in the nearby town of Monrovia was upended.

Janelle Brown, 38, said the house she and her husband moved into a week ago in Los Angeles's Silver Lake neighborhood narrowly escaped a direct hit from a large 100-year-old pepper tree that was uprooted in their backyard overnight.

"We woke up this morning, looked out the window, and realized it was gone," she told Reuters, adding she and her husband never heard it fall.

"We lay in bed until 1:30 in the morning listening to the cracks and the pops and the wind rattling the windows, and then finally fell asleep," she said.

Brown, a novelist, said some branches from the tree came to rest on top of her house, and "there's a little bowing in the roof, but from what we can tell, we got lucky."

Public schools in Pasadena and 11 other districts in San Gabriel Valley, northeast of Los Angeles, were closed for the day, though the Los Angeles Unified School District said it would remain open.

The Los Angeles Department of Water and Power, the nation's largest public utility, reported nearly 130,000 customers were without electricity Thursday morning.

Southern California Edison, which serves areas outside the city of Los Angeles, said outages that began Wednesday night had affected more than 225,000 homes and businesses.

Tyler Perry offers support to boy in Penn St case (AP)

PHILADELPHIA ? Filmmaker Tyler Perry is expressing his support for an alleged victim in the Penn State child sex-abuse case, calling him a hero for coming forward.

The producer and director, who went public last year with his own story of childhood molestation, made his comments in an open letter published Monday by Newsweek.

It is addressed to a boy who was 11 when he reported alleged sexual abuse by former assistant Penn State football coach Jerry Sandusky. Authorities arrested Sandusky on Nov. 5 and charged him with molesting eight boys over 15 years. Sandusky says he is innocent.

"Do you know that at the young age of 11 you had more courage than all the adults who let you down?" Perry wrote. "All of the ones who didn't go to the proper authorities, all of the ones who were worried about their careers, reputations, or livelihoods."

Two Penn State administrators have been charged with lying to a grand jury and failing to report a 2002 allegation against Sandusky to authorities. Football coach Joe Paterno and university president Graham Spanier were ousted following criticism they should have done more after learning of the accusation.

Perry said he didn't have the courage to speak up when he was 11. When he finally did tell a family member about his own abuse, Perry said, the relative did not believe him.

"I suffered in silence," he wrote. "But not you, my young strong hero, you have done what many of us wish we could have done. You used your voice!"

Perry later added: "No matter what happens next, just know that the hardest part is over."
